I just think since he had already been charged when the lineup was done he should have been given a lawyer at that time, It seems to be critical that he have one then, If he did not have a lawyer I think the ID at the lineup should be tossed and since any further ID would be tainted by that, that I D should also be out.
Now O.P., you are telling more of the entire truth! You made a huge deal about a line up in your first post. Innocence Project with Barry Scheck & John Grisham has demonstrated eye witness testimony is mostly garbage. Your buddy was in the area, Opportunity. Your buddy had items from crime scene on his person AND your friend looks like the arm robbery suspect. How do you know your friend is innocent? Your friend has not given an attorney a lot to work with. You now say your friend looks like the perpetrator. You did not say that when you first posted. Your friend was in the area. Your friend had items from scene of the crime on him. A first year law student acting as prosecutor could convict your friend. Stop blaming lawyers.
