First, let me begin by saying I am NOT a lawyer, but I do have a a Criminal Justice degree from a very well respected regional school. Plus, I have a girlfriend who works at a large local law firm (40+ attorneys) and she gave me her password to use her Westlaw account.
My best friend was arrested in March for an armed robbery he did not commit. He was brought down to the CJF and booked. While he was there - THE SAME DAY he had his initial appearance, right after it, the cops put him in a live lineup and he was identified by the "victim. " His lawyer was not told they were doing a lineup and so he did not have a lawyer there. The BEST evidence they have he did the robbery is the ID at this lineup. But he did not have a lawyer at it. I think this is the BS and he should have.
I keep calling his lawyer and he won't take my calls but I am pretty sure if he did not have a lawyer then they cant use the ID. His lawyer won;t talk to me and is telling my friend his "goose is cooked" whatever that means and so he needs to plead and take the deal. He is hoping with the plea deal he gets 5 years in. In my state we have "truth in sentencing" so 5 means 5.
HOw do I get his lawyer to listen to me? How do I get my friend to listen to me? Should I just shut up and talk to his appellate lawyer?
