To answer the above poster's question, it is based on whether the courts determine that the protection of the 2nd amendment being challenged warrants intermediate scrutiny vs. strict scrutiny. If you think the core protection is that the 2nd amendment protects guns, your position makes sense, however if the core protection is, as this case finds, being able to protect oneself in one's home, then the analysis only requires intermediate scrutiny as one can do that with any gun, so a particular gun can be banned
