This is the classic definition of a unilateral contract.
They put an offer out there with the terms: time deadline, performance required, reward.
No notice of acceptance is required for unilateral contracts. Performance would constitute acceptance.
I would be very careful dispensing legal advice . . . if Mike did in fact run a 20m 5k within the time period, and the Brojos refused to pay like you say, it is possible that they would be in breach and have to pay the original reward plus other damages. This is by no means as cut and dry as you suggest.
Are you an attorney?

Yes but not practicing. I'm a MEMS research engineer.
Are you der der der from the 9/11 thread last month?
Mike will get an official photo of himself finishing in 3:09 or whatever it is. NYCM might have a lot of chip mats
Rojo, if Mike runs this 3:09, but coincidentally one mat malfunctioned and one photographer overlooked him, will you pay the $100,000?

If the brojos are getting legal advice from this board then the world is in trouble.
What kinda advance notice is required mr. Lawyer?

Mate, your trolling is 3rd tier. Just quit.
My final opinion:
A man who quotes Sinatra is calling his shot. Withdraw the offer now just to save any contention or hassle.
Dude is gonna run sub 3.

This forum would be much better if trolls like you would abstain from constantly calling others trolls. So lame. So boring. Such a stupid straw man discussion. Here for example, I just asked an innocent question.
The real trolls are the ones like you with the absurd conspiracy theories involving Yasso, Barb, VIA, USATF, local runners etc, and of course the guys who directly call themselves trolls or trollinater or sometroll or trollbloke etc.
Just accept that Mike beat you fair and square with his 3:11.
The Dude would have a better shot than Cheater Mike Rossi.

You can't read.
No notice of acceptance is required in a unilateral contract. None. Zip. Nada.
Did that help?
Rojo, thanks for bringing a little life back to this thread. No changes, just some trolls and some evidence of what a dirt bag, low life MR is in general (tweets trolling the reporter in particular).
Mike Rossi cheated to get a Boston Marathon time and everyone knows it. And unfortunately this wasn't just a one time slip in character, everything he's done since indicates he's a dirt bag.

If Mike cheats at NYCM, the NYRR will DQ him. Period.
If someone runs in his bib, they will DQ and ban him.
This all has come up long before people even heard of Mike Rossi.
I don't see a sub 3 or anything close at NYCM, by what Mike has written on Facebook in the past.

Oh now Rossi is gonna run 309?
LOL!
That is the only funny thing you've said while trolling for months. I got more laughs pretending to be Rossi as "I am Rossi"
You're just posing as some weird fan of rossi. ... what is point?

You didn't get a kick out of him saying Rossi has good integrity like Clinton? Or that the vicious and potty-mouthed Rossi, who has never publicly mentioned god or religion, is a fine Christian?
Those are what I was referring to when I said SmartRunnr gives us a wink now and then to let us know he's not serious.
Whatever floats your boat.
To be honest he trolled like the same 2 guys for months.... I think it is more interesting that they never figured this out.

Please give up.
90% of my posts on this forum are about running and training. Troll label does not apply.
When it comes to mike, I have no conspiracy theory. He cheated, the RD decided not to act. Fair and square. His 3:11 is as real as your girlfriend. Oops.
Given the trolling skill level and posting history, I'd say SmartRunnr is likely an overnight nerd between 14-16 yrs old.

Oh please. If you weren't trolling, why did you respond to a polite, on-topic, running related question with such a lame trolling accusation? Do you really want to pretend that that was a constructive on-topic contribution of yours?

Exactly. Finally you are getting serious and are seeing the light.

I read quite well. I think you are right as far as Pennsylvania in 1980, I am not gonna cite check to see any overruling, you can do that. In fact it appears MR would not even have to know about the offer let alone communicate acceptance of it until after he performs - communicate acceptance being merely poor word choice for collecting.
I was asking what kind of "advance notice" is the condition as set by the offer. The offer says must have some advance notice. I was asking what would that constitute. Seems that distinguishes this from a reward case, because Letsrun is owed some kind of notice in advance of any run. What would constitute that notice? Notice from the runner? Notice in general?
Seems the court would go with the premise that in the circumstances the runner can't email Letsrun 2 seconds before the starting gun and then collect. What would it be? Mildly interesting.
And could Letsrun then withdraw the offer? Seems like they could before the race.
I think you are using textbook examples and not getting into the distinctions of this. By example if someone offered LMR $10000 not to run a sub 3 marathon could he collect??? I do not think so, but you can answer to explain. Likewise, the offer to the runner had some conditions, advance notice is almost like communicating acceptance, but what would keep Letsrun from withdrawing that offer halfway through the race? Nothing,
All Rojo has to do is yell "offer withdrawn" before he crosses the finish line and it is over.
Maybe you can represent the runner someday if he achieves the time and tries to collect.
Not trying to antagonize you.
Ok you wrote a long post. I don't know what is complicated here.
First, just tell me what you think a unilateral contract is. What is the difference between a bilateral contract?
This is their offer:
"We will give Mr. Rossi $10,000 if he breaks 3:25 in the marathon (standard course) in the next 12 months. That’s nearly 20 seconds a miler slower than his “official†PR. Update on 7/17/2015: We will pay him $100,000 if he runs 3:11:45 on a legitimate records-eligible course in the next 12 months where we have advanced notice of his participation ($10,000 per year for 10 years). A media outlet interviewed us today and asked about how the 3:25 challenge came about and we said, “We tried to come up with a time that was at least theoretically possible to preemptively rule out his excuse of, ‘I can’t be expected to have the race of my life once again.'"
Look up this:
https://en.wikipedia.org/wiki/Lefkowitz_v._Great_Minneapolis_Surplus_Store,_IncThe terms of their offer are definite to a reasonable person, providing ascertainable conditions by which the offeree would be bound:
- break 3:25 within 12 months
- it needs to be a legit course
- you need to tell us when so we can be there
- you get paid in installments
If you do all those things, we will give you $100k.
You are so hung up on the condition that they be informed of the place and time. Its just a requirement of his performance.
The underlying point I should note is that you answered Rojo's question by being pretty cut and dry "oh yeah no way it is enforceable . . . " WRONG. That is bad advice. Like I said, there is a very real chance that it is enforceable.
Great interview with Steve Cram - says Jakob has no chance of WRs this year
