Isn't it great how one person in a position of power can strike down a whole state's preference?

It was ruled unconstitutional. Doesn't matter whether it was preferred or not.
Don't worry, nobody is going to rule gun ownership unconstitutional.

Right, and only nine people negated "separate but equal" at a time when that was widely preferred (or at least widely accepted).
If something' against the Constitution, it's against the law.
isnt it great that a majority can vote to oppress the rights of a minority (when the actions of the minority have no impact on the majority)? Ever hear of tyranny of the majority?
Di you favor brown vs board of ed? The forced integration of public schools?
I am always amazed when people cite this as the 'obvious' case of why the law/state constitutional amendment must be sacrosanct.
It is like they do not understand the separation of powers; neither do they understand why there should be the separation of powers. It is even more 'amazing' to hear it from people who are ardent 'supporters of the founding fathers.
Note, I am NOT saying that everyone or even most favoring support of the Constitution/Bill of Rights do not understand and support the separation of powers.
Also, when it is not one person but a panel of three in some cases and in 14 cases, the same conclusion has been reached in all cases (well, there are two types of cases, in one it is the narrower issue of recognition of marriages in other jurisdictions). Now that is a lot of reason to suspect that the legal basis is on pretty solid ground -- generally the US Supreme Court decision plays a role in almost all of these decisions.
It is funny that people want to say these are liberal judges when they are just trying to enforce the constitution. Good that in 20 years this will have all seemed so silly.

Wasn't this PA guy a "conservative" judge and Bush appointee anyway?
Yes, but that doesn't make all the conservatives not want to scream liberal conspiracy, gay agenda and other buzz phrases.
