I never said the Hunter Biden laptop was relevant to the case. I simply pointed out how absurd it is for the Democrats to try to claim Trump was interfering in an election with the National Enquirer while the Democrats literally had the FBI lean on the print media and social media to kill the laptop story to directly interfere with the 2020 election.

The prosecution, on the other hand, disclosed their argument about the crime at leastlast November 9, 2023 (and probably much earlier) in the Response brief that I conveniently linked for you one day ago in Post # 4557 on page 228 of this thread.
The Judge also had an opinion on what the crime is as well in the Order dated February 15, 2024 that I also linked for you above. The "mystery crime" you complain of was disclosed at least last November 9, 2023, not last week. There is no "mystery crime." You look really stupid and uninformed posting otherwise.

Never forget this point. Trump's lawyers argued that it was wrong to impeach Trump for these election crimes because the US Justice system was the appropriate venue to address Presidential crimes. They are now arguing exactly the opposite.

I wouldn't go that far. The argument of immunity for official acts comes from the case that decided presidents have immunity from civil cases for official acts. It's not impossible to see how that could be extended to criminal cases. It's a legit argument.
That hearing was intense. I think this case will be remanded down to the district with a ruling that official acts can be immune from criminal prosecution. But I don't think the SCOTUS will require the district court to hold some separate pre-trial hearing to determine what is and what is not an official act or even require a pre-trial judicial decision on it (which could then be appealed by Trump back up to SCOTUS), before the trial. I think the district court will be able to send all the "official acts" issues to the jury as fact issues for them to resolve. I think Barret pretty much confirmed that will happen with her questions on the procedures on remand.
The only Justice I see in the can for Trump is (predictably) Alito, who all of a sudden sounds like a born-again ACLU lawyer with respect to the charges on Trump, when he usually rubber-stamps all death penalty or Miranda, etc. cases before him. Alito doesn't even try to hide it any more. He did a better job arguing for Trump than Trump's lawyers.

My hunch is that Trump will beat this due to a fast news cycle and people having short attention spans. The delay tactic will do just enough to get him into the election (win or lose). If they kick this down to a lower court and stall throughout this summer he will win this battle. Somewhat similar to Putin's attempts to gaslight everyone and get to Nov. 2024...
