There are two kinds of positive tests. The ones where the athletes knows they are taking a banned substance and the ones where the athletes has no clue. How do you distinguish the two? It's tough to know who to believe, that's why I don't like lifetime bans. If I'm taking protein that somehow got contaminated in the lab I don't want to be banned for life.

Just like in any legal act, there are varying degrees to intent, recklessness, culpability, the harm caused and the act itself etc. We don't treat a traffic ticket the same way as murder. Should she we assume any athlete caught cheating at age 30 was cheating at age 20? In Gatlin's case, he served a 4 years ban, which 9 times out of 10 is a life sentence. Perhaps his punishment to some seems trivial because he has made such an incredible comeback. l assure you that any professional athlete losing 4 years in the prime of their career is not a lenient punishment. What Gatlin is doing now speaks to how naturally talented he is without drugs and the fact that for 4 straight year he never stopped training. In Gay's case, WADA was able to verify that he cheated during a short window and with some level certainty that he did not take part in the purchase, acquisition and cover-up of his drug use. Gay did not use masking agents, competed in meets with the drugs in his system knowing he would be tested, which would make him incredibly stupid or perhaps he was not aware he was doping. All of that aside, Gay was treated the same way the U.S. legal systems handles all of crimes, if someone provide information or in some way benefit the court and law enforcement, you are allowed to plea bargain down your sentence.
I have no pity for drug cheats, but being reasonable, there is absolutely no way you can simply say a lifetime ban and remove all of an athlete’s performances from the record books.
