I also included his age in the description, why did I do that? I guess originally I was planning on being more detailed in my story. Eventually I started writing and was more brief. What if the cops pull him over and find the weapon (either concealed or not concealed). If there were 6 people in the car can they act as witnesses to the crime? I really don't know the law to be honest, that is why I'm asking. We were minding our own business I assure you of that... we noticed him staring at us. I'm not from the suburbs, I live in the city so I'm not can't just stay away.
So basically what you are saying is if you tell a cop that he pulled a handgun, the cops pull him over and find the gun, but he says he didn't pull it they are going to believe him?I assume the cops will say it was just a lucky guess that you knew he had it, right? A. If enough people saw it, they could file the claim if the police just pulled him over. A buddy of mine flashed a toy gun once while in the backseat of a car and the drivers called the police and my buddy got pulled over and searched.
B. Even if he has a permit and could conceal it in his car, that would not give him the right to point and aim his gun at another person on the highway.
C. Self Defense by threatening deadly force only works if you have a reasonable belief that you are about to have deadly force or substantial bodily harm impacted upon your own person (or that of another). Depending on the state statute, it may even require that if you have a reasonable means of escape you take that before you try and use deadly force. Feeling "Threatened" because he was being followed wouldn't cut it.

Um, Mexicans tend to look a lot different than South Americans. The latter are mostly Spanish/Dutch descended, whereas most Mexicans are predominantly Native American.
Something similar happened to me recently. Hispanic "gentleman" tried to avoid traffic by going moving up a non-lane and then cutting in at the last minute. I would not let him in. So he pulled his car forward pushed open his door and stared me down. He then basically just forced his way in and as he was in big SUV he got in. As I was with my girlfriend I was glad nothing happened but I thought what the guy did was tantamount to road rage. My question is - were i to report this incident to the police would anything happen. My argument would be that if my girlfriend and I felt threatened then perhaps something could be done.
