It definitely does depend on the state. Also, pre-nups are not iron clad tools. They can be and are challenged in court with various outcomes.

My girlfriend made more than her ex when they got divorced and now she pays him child support. I don't think it's always female-biased. In Colorado, my experience is that they calculate the child support based on the earnings of the two parents and ignore the genders.

Good to know. I think I did read that you would often have to get your prenup updated as life changes occurred (kids, for example).
Also, to the previous poster, I did know prenups aren't iron clad. But they are better than nothing, IMO.

Because it’s based on income guys and amount of time. And if you have a potential income that is higher than you actually income then guess what the court will use? You can’t just work at McDonalds when you have an engineering degree and avoid support.

Funny response to me. In my response to OP I was simply pointing out the merits of calm cooperation. In most divorces, unless the future ex-wife has, to put it nicely medical problems, the man will walk away with about 48%. Female attorneys whom practice family law know this. Females planning on getting divorced know this. The people who push back on what I stated are: female governors, female attorneys general and female family court judges. All three want to pretend family court is equally fair to men and women. Again, gist of my recommendation to men facing divorce, cooperate!

Don’t get me started. Ex got a DUI with my child in the car. I had full custody and for some reason judge states Mom is innocent until proven guilty. So I will continue to pay 2,252 a month for another year then only 750. It will pass but for now enjoy life.

Prenups have NOTHING to do with child support, regardless of whether the child exists pre-prenup or not.
Child support is for . . . wait for it . . . support of the child. The child's rights to their own support cannot be signed away by any pre-existing agreement.
This is how the law of the United States of America works. You can knowingly turn to him every time, maybe you can somehow make the situation better in your favor. or just hire a lawyer
