I mean if people are 'flooding' over the border in populated walled sections like our border offer claims is happening in San Diego...how is a remote all, miles and miles away from border patrol going to stop people from using ladder technology?
Here’s this national emergency debate in a nutshell:
1. Can the president declare a national emergency for the border? YES. A president has broad power to declare a national emergency. It could be a national emergency on bubble gum. It’s just words. The actions he can take are limited by the 123 powers he can use without Congressional action.
2. Is this really an emergency? An emergency is defined as a serious, unexpected, and often dangerous situation requiring immediate action. If we currently had columns of thousands of immigrants literally pouring into the border then yes that would be an emergency. Right now it doesn’t pass the eye test so instead you get Angel Moms, and fear tactics to elicit an emotional response. It’s disgusting.
A better solution would be to increase the number of agents, increase technology, increase judges and courts and simply speed up the processing of immigrants.
An even better solution would be to make E-Verify mandatory. I’m not sure what the argument against this is.
3. Can the president use military funds to build the wall. Legally probably not. We will find out. The narcotics money has to be spent this year and that’s not likely with the court battle. It’s unclear if the construction funds can even be used as it doesn’t affect a military installation or military personnel directly. Also there’s a big uproar that these funds are being taking away from housing improvements and other base modernization efforts. As an example my office building has asbestos and lead paint.
I don’t think Trump expects to get his wall built. He just needed to kick the can down the road to 2020. After 2020 it won’t matter because either way he won’t have another election to worry about.
