I guess this is why in NYC building managers have to write to their tenants within 30 days of them moving in and every year thereafter asking if they require window bars. Tenants have to reply by law. All apartments with children between 3 and 10 years old are required to install window bars by law. I guess it stops frivolous law suits like this.

She might have a case. If this is a HUD property, bars on the windows are mandatory. However, to claim it's someone else's responsibility to educate you as an adult of the dangers of falling out of a window, is ridiculous.
In my opinion, the problem here isn't the arrogance of this plaintiff. It's that the court systems actually listen and in too many cases reward these people money.
So unfortunate of that lady to have taken such a blow. I would suggest the only option left is to have window bars. Safety is of paramount importance for everyone. But I can't imagine of a situation where I would my dear ones to sheer negligence. I have window bars installed at home. These days attractive window grills are available.
