Toyota's brake problem was but a blip compared to the problem created by BP's rig disaster. The way they've handled their problems is similar in style, but the scope is completely different.

The law is far less settled, too, with the BP situation.
Maybe that has something to do with the class action suit in the Valdez case taking 21 years with a sizable, but hardly earth shaking settlement of about 1.4 billion dollars.
This disaster will create some new law. By way of example, if a hotel on a beach suffers from an oil slick, the hotel has an action for economic damages. But what of the hotel or restaurant two blocks inland. They likely will have few tourists either. But the law is uncertain.
I could see BP heading the way of Johns Manville and asbestos at some point. Bankruptcy may be a way to funnel litigation and structure universal settlements. Not a pretty picture, and the comment distinguishing Toyota from BP is an exceedingly valid one.
