If the team makes up the difference it is a scholarship. If the school has a program available to all students that would reduce your tuition then it is not a scholarship.
A DI school might offer you an in-state equivalent schlarship, but you would have to make up the difference. That would save them some money (as opposed to the cost of footing the bill for your full out-of-state tuition). Nevertheless, they would still be using a full scholarship (i.e. a full ride) if they offer you in-state. You had better be good to land such a deal.
It will depend on what the college uses as it's base cost of college figure. Each college works off of a percentage of total cost of college when giving out "athletic aid". Thus, if a figure of say $10,000 and instate tuition is only $9,000, it would only be charged .9 tution out of a total of 1.0. Division one men have a maximum of 12.5 scholarships. I think women are up to 18.5 scholarships, but I could be wrong on that figure.
