This situation stinks for him. I hope he figures out a solution soon. According to his facebook page: "I am aware that the site is down. This is because I am fighting a DMCA Take down notice and refuse to take down photos that I had every right to publish. There was a reply in either his latest or second latest post that mentioned him violating copyright laws or some crap by posting photos. I'm sure its cached and you find it.
I would bet whoever posted that is the person who filed the complaint.
Feel bad for Derek as he does seem to be a nice guy and appears to do things "by the book", ie presents facts, only uses photos that have been publicly posted or buys the photos outright from the race photog.
Just read the latest on this on the Facebook page. Apparently it WAS one of the people from his recent posts (accused of serial bib forgery) that filed the DMCA complaint.
Clearly fair use, but the ISP has to pull down the page or else they could be liable in a civil suit of double did anything wrong.
If doublr's got all his i's dotted and t's crossed on his counter claim, the site should be back up soon. After that it would be up to the filer to decide if they want to pursue it in court.
Unfortunately there really aren't any teeth in the DCMA for punishing those who file false claims.

I believe that in some of the cases the humiliation is over the top. Jane Seo cheated in a minor race, but it wasn't a criminal act. The negative attention she received will affect the rest of her life. Getting disqualified from the race and being booted from her running club would have been sufficient punishment.

And then she biked the course at a very slow pace to create a Strava record that would look like she legitimately completed the course. And then after being confronted with the evidence she initially doubled down and claimed that she completed it. I think that kind of deliberate deceit is relevant and should always be a part of the reputation of someone that claims to be a journalist.

Back in High School, I was taught what was at the time described as the "equation of crime" it went like this: If the potential punishment of the crime was less than the benefits of committing the crime, then the crime pays off.
This is our problem with all these things...sure they are not real crimes, but they are wrong and people do them because for the most part the ramifications are minor and it's worth it to do the wrong thing. In a very small segment of society...running races...Derek has been successful in turning the crime equation around so that yeah, the potential punishment is way worse than the benefit these bozos get from committing these acts. Perhaps over time, people will realize that maybe it's not worth it, and to me, that's a big win.

Looks like the site is back up. The article "Serial Bib Forger Uncovered By Social Media Posts" appears to have had all its photos removed.
