I re-read my last sentence and realised I omitted a word (should have been "arguing it shows" rather than "showing", but I don't think it changes the meaning:

I'm not claiming it's an alibi (that's where you have evidence of being somewhere else). I'm saying that if he had no recollection of the event, was he really lying? It seems he did attempt rape or at least sexual assault. The question that remains is his probable lies about it.
