Let me start off by saying I run a lot at night (just works for my schedule better) and am careful to take every precaution to be safe that I can. I've always worn a reflective vest on night runs, and I've even added some reflective tape to my shoes as well as my hydration vest. I've come too close to hitting runners myself while driving that I know this is necessary. Up until tonight I had never used a headlamp though, as I run where there are enough street lamps. However, I was at the store the other day and saw a headlamp that featured a blinking red light mode. I figured this would be a great way to increase my visibility to drivers so I bought it.
So tonight I go out for the usual 5 and am trying out the new flashing light mode on my headlamp. I'm about a mile in and hear sirens behind me. I look back, expecting to see someone being pulled over, but there is no one but the police car! He starts to slow down behind me (I was on the right side sidewalk) so I stop and sure enough, he was pulling ME over!!! As weirded out as I am by this, I want to get back to my run asap so I go over to see what he says. He explains to me that I can't wear my headlamp on flashing red mode because it could be mistaken for flashing lights and a distraction to drivers... WHAT?!? Maybe I'm crazy, but who in their right mind would think that? I say something like "With all due respect sir, I'm not going to be pulling anyone over on my runs." I was holding in a bit of a smile, but he didn't seem to think it was funny. He let me off with a warning, but said if he saw me with it on again, he'd give me a ticket.
What am I supposed to do? Are there actually laws about this? Is he completely out of line? All I wanted to do is make my runs a little safer...
