The jury has now moved on to mitigating factors – the arguments put forward by the defense. Tsarnaev’s lawyers pressed the case that he was manipulated by his brother Tamerlan.
Three jurors agree that Tsarnaev acted under his brother’s influence and would not have committed the crime otherwise.
Eleven agree that he had no prior history of violent behavior.
Three agree that Tamerlan planned, led and directed the attack.
Eleven agree that Tsarnaev’s friends thought him “thoughtful, caring and respectful.”
Twelve agree that the mental illness of Tsarnaev’s father made Tamerlan the dominant male figure in Dzhokhar’s life.
Five agree that Tamerlan became radicalized before his brother.
Two agree that Tsarnaev “has expressed sorrow and remorse”, and only one finds Tsarnaev unlikely to commit, incite or facilitate future acts of violence.

Seems to me spending the rest of his life alone in prison is much worse punishment.
