This is a serious post. Please help me.
A number of months ago (like maybe 20?), I received a water bill that was like $1500. My normal bill was like maybe $200.
I called and they said there was some sort of mistake. It seemed like to me that they just randomly reduced it to a level that they thought I might pay like say $1200.
Anyway, it comes out that I wasn't the only one in this predicament.
It turns out that what had happened was that the city had a line from your water meter out to the street that estimated your water use and you were billed on this estimate. The city was supposed to come by every so often and read your actual meter which of course they never did.
Turns out they hadn't read the actual meter in like 10+ years. When they read it and it was off, they just sent people mammoth bills.
Now I think this is unfair in general.
If this was a private company like say cell phone, and they came to you 10 plus years later and said, "Oh by the way, you really used $1,000 worth of extra minutes seven years ago but we never told you," there is no chance in hell that they would be allowed to collect the money.
The city did apparently find out that the statute of limitations was 6 years so they reduced the bills by some sort of yearly percentage (say 40% if it was 10 years since they checked the meters) but honestly, it felt to me that they were just making the numbers up. To me, doing it by a percentage is wrong as there is no proof that the resident used that water in the last 6 years that the law applies to.
Regardless if you agree with that reasoning or not, my case against the city is lock tight for a simple reason.
I didn't own my house when they city last checked the meters say 10 years ago. I've only lived here for 5 years so in my mind, there is no way I should pay as they can't prove the previous owner didn't use the water.
I've been vocal about this and was featured in the front page of the paper as the city was deciding what to do. They finally said everyone would have to pay.
I was still enraged and called up the city and the city told me that I'd be notified when the board of public works was meeting and my case would be heard then individually. I was never notified or called to a meeting.
Near the end of the 2009, I got a water bill that was much less. I was very pleased and assumed they had dropped the matter. I called up to make sure and I WAS STUNNED BY THEIR RESPONSE. The lady admitted that they had simply just moved my obligation over and added it into my property/school taxes without telling me.
IF THIS ISN'T POLICE STATE LIKE,I DON'T KNOW WHAT IS. They never bothered to send me an email or letter or anything. They never called me to the meeting and just tried to trick me into paying as everything is rolled into my mortage.
I'm wondering what my options are.
I'd like to continue to raise a ruckus. The problem is lawyers are very expensive. Is there some sort of freedom/rights group that might be interested in this type of case?
What type of lawsuit could I bring against the city? I mean if I'm just suing for like $1000 it's not going to make sense to pay a lawyer more than that to do it. Could we do some sort of class action suit with the other people effected (50 to 150 people i think?) so a lawyer would be interested? Or could I sue for some sort of punitive damages so I don't lose money on this?
I want to be clear, I'm not looking to make money off of suing the city as despite what people think, when you get money in a lawsuit against the government, it isn't free money, it's coming from your fellow taxpayers.
I just want to send a message to the city and recoup my expenses. Any money that is left over would be donated to charity.
If class action or punitive damages aren't an option, can i sue the city in small claims court?
