The pictures are still up on her Instagram. The pictures were not toxic. The men were not 'nearly naked' they had long pants on, and no shirts. The key point is that they were willing participants in the photo.
She is reacting to a situation that she did not cause, or did not ask for.
I can't believe he was charged with misdemeanor sexual battery...this is a bit harsh.

There's a big difference if the slapper is much larger and stronger than the slappee. It's likely you would have had a different reaction if you were a petite woman that was butt-slapped by a 200-pound guy.
Why? In either case, there is no threat involved. It is simply inappropriate behaviour. Personally, I took it as a kind of compliment - albeit of a fairly vulgar kind. There is such a thing as overreacting to perceived affront. Criminal charges could easily qualify.

If the reporter was a man I'd still not be upset that the law is being applied and would still call out that the previous poster was intellectually dishonest in the wording provided.

My thoughts:
Not a fanboy of MI, but I value its contribution to exposing cheats, Frank included. MI does a great service to those who value the honesty of marathons.
Derek does most of the legwork himself, of course (esp in the FM) story , he gets a lot of help from others trying to show off their amateur sleuth work, and he does credit them. Seems they want more.
The helpers (like elves) like yourself don't want Derek to have different social norms to themselves, how dear he have his own thoughts on the issue??
The runner slapped the reporter intentionally on the butt, blind Freddy can see that. His apology is a lie, it wasn't unintentional.
Is it assault? Depends on who the victim is. I wouldn't have regarded it as such on myself, nor some ladies I know. But this lady does feel that way.
Let the courts decide. This has nothing to do with the victim's own private or other public actions or photos...do you somehow think that the bloke knew all that before deciding to slap?

I'll stick my neck out and suggest that for many people - especially men - being slapped on the rear may be seen as inappropriate behaviour at the most, presumptuous (when it isn't invited), and maybe not even offensive - or it would produce many more complaints. It could be seen as being more in the category of intrusive and rude behaviour. We don't usually prosecute people for that, even though we would call out such behaviour as objectionable - especially in the workplace, where it can constitute harassment. That doesn't apply here. But even for those who are highly offended - like it appears the reporter and her supporters are - the standard would be how most in the community would see it, and not those of a particular sensitivity. And currently most wouldn't see it as criminal behaviour - whatever the letter of the law provides.
