You never want to wound the intruder. Killing the SOB is the best thing to do. If you hurt him then you will get sued. There are attorneys that look for that sort of thing.
In Texas, if the intruder is on your property (outside, trying to break in or messing with your car) then you will probably not be arrested for killing him. If the intruder is inside the house then you definitely won't be arrested. The case may go to a grand jury which will ultimately no bill it.
You can even defend your neighbor's property by killing a suspected intruder without fear of being arrested. Reasoning is that the crook is typically targeting the neighborhood.
