Does Nike actully sever papers?
I've been in their office, and they have a huge paper shredder in the corner.

Imagine if you were an engineer and you quit your job and went to work, right away, with a competitor soon after. In the software world they have non-compete clauses for such things.
I think a similar scenario would be if Berian was briefed on future shoe designs or gave input on future shoe designs (much like Mo does). If he quit right away and jumped ship to a competitor's contract then Berian could be divulging sensitive info before Nike even revealed their next year's shoe models.
If that is the case then Nike has all the rights to sue the shit out of him. I bet there is a clause in his contract that forbids him to jump ship within the same year. Read the full contract Berian before you jump ship .
I agree we should get facts but are you an idiot?
Do you really think Nike is sharing future shoe designs to Boris Berian? Really? That's laughable.
But even if that is the case I don't believe it would be "breach of contract" case, wouldn't it be a totally different lawsuit. Like some sort of an intellectual property or trade secrets suit?
Again, I'll try to get some fact. This idle speculation is entertaining but ultimately a waste of time.

Umm...your company started this thread and stated that you have the runner's back.
In this instance, it's clear Nike is giving him a public scolding for falling out of line. They just want to send a message to others who think they can just breach contract to earn some extra bucks. It won't amount to anything, it's really just a public intimidation tactic.
For a good 95% of T&F athletes it's a pimp/prostitute type of relationship, the pimp owns the prostitute. Boris is poor like most of the others and so will inevitably sign a ridiculously lopsided contract with a big name like Nike simply because they have no other choice (financially speaking). As a world champ, he'd have to spend tens of thousands of his own dollars to travel the world to compete at big meets. The choice was simple. Obviously, the money offered to him was peanuts, which led him to look for additional cash elsewhere. To summarize, there is nothing to see here. Everyone knows the score, you take whatever cash they throw at you and keep hustling until you retire.
You just need to find an attorney who can login to Pacer. It's public record you just need the subscription to the federal pleadings system.
Taking sides before you know any facts? Huh, who knew the brojos were SJWs?
Actually... I think you can register for Pacer as a non attorney. So there you go Rojo...
My feeling on this suit is that it is just something to waste Berians time and take away his focus on training so that Nike can get as many athletes in the Olympics as possible.

You have run this site and read these boards for HOW MANY years and this behavior "amazes" you??? Your statement is what amazes me .

Don't worry rojo! You just got served, but we have your back!
Nike is a metastisizing cancer to the sport of track and field and should be chemo'd before it completely kills it off. They can make plenty of money selling their overpriced garbage to football and basketball players who are too dense to realize they are being swindled.

https://dockets.justia.com/browse/state-oregon/noscat-1/nos-190It means they live/reside in different states. Which also means the suit is for over 75k or it wouldn't be in federal court.
?? I've been peripherally involved in a number of lawsuits across State lines as an involved employee. The contracts stipulated a State that any matters would be adjudicated among a long list of T&C's. I never heard/saw any Federal Courts anything. I'm in the tech industry. Litigation is an industry inside the tech industry.
They know Berian won't ever be able to afford decent defense and so he becomes the example for all other athletes to mind. Fear Nike.

Thinking the same thing. LR promotes this thread and makes proclamations about having BBs back, and then call out people for being idiots for arguing without facts.
Keep digging your website grave Brojos. Good riddance.
That "bum" also made over 20 million in 2013 and is CEO of one of the biggest cell phone companies. But you probably have more knowledge about legal issues than a man who has attended MIT and Harvard.

College isn't difficult. Millions of un-intelligent 18 year olds manage to show up to class and do the basic level of work necessary to earn a degree. You barely have to be literate to graduate college.
This is not a man who makes intelligent long-term decisions. He's an immature guy who's lucky to be incredibly fast. My instinct would be to side with Nike on this, at least as far as the legal situation goes.
yup

yep
sounds like the debate is whether or not nike's offer to him at the beginning of the year "matched" NB's or not
Looking forward to hearing more about this.. Interesting
isn't wearing gear of other companies already a breach of contract and sufficient to get you fired? why sue when you can fire them? when they turn out to be a lot better than you thought last year when you picked them up for only a short period, not knowing whether they'd be a flash in the pan? Props to Berian for going public with this.
