They weren't Kenyan government officials. That's why it's not FCPA.

Even if Nike was legally correct. Suing an individual athlete is a D!ck move. a DICK move. What do they thing to accomplish? Boris was unsponsored for a while, it's not like he has $$, as a PR move it's absolutely terrible and Nike is usually better at PR.
The good thing is that if it's filed, it might be public record (look for Ken Goe to do a pro-Nike piece). Nike will probably try to keep things under seal.

Don't be an idiot. No one is saying that Nike doesn't have the right to defend the contract (you seem to know more than rest of us so please share) but just because you can sue doesn't mean you alway should sue. I'm sure there is more to the story that we will find out.

A attorney who might help Boris should find out about the financials first. Did Nike stop paying him? Did Boris stop accepting checks?
There are two side to every contract. I have read and signed contacts with large entities like Nike (Ford, Toyota, Major Cities) and it seems likely that the contact is heavily one-sided in Nike's favor. Nike could have a clause where they own right to you even if they stop paying you. Nonsense of course, and worthy of a legal challenge to Nike. I could always get real nonsense clauses removed, but many people sign contracts without actually understanding how hamstrung they might be.

How can you not support Boris here? Seriously, Nike is a huge corporation with an freaking army of lawyers. Suing the lone athlete, regardless of fault, is pretty petty. I get you need to enforce your rights, but there are a 100 ways to do it before a suit and 10000X smarter ways to do it.
