That's not the law in any state in the USA. If someone jumps out in front of a car/bike and gets hit, the driver/biker is not going to be at fault. Pedestrians DON'T have the right of way when they jump out into oncoming traffic. It's unclear exactly what happened here and who is at fault but it's not definitely the cyclist.
You also are wrong in concluding that since he had time to yell he had time to stop. He was going downhill there and could have been going 30mph. He also could have slowed down a lot and hit her right before he stopped. His bike doesn't look mangled so I assume he had slowed down when he hit her and her head injury came from her head slammed into the road. The NY Post did such a bad job reporting this that it's hard to sift through what is fact and fiction here.
