Concur. This latest by Armstrong -- the squandering of huge amounts of money to pay lawyers to advance a hopeless argument -- underscores just how desperate (if not delusional, at this point) this fraud is.

Graham v. United States Anti-Doping Agency, 2011 U.S. Dist. LEXIS 34637 (D.N.C. 2011)

The court stated, "Again, although Graham, similar to Lee, purports to present claims outside of the Amateur Sports Act, namely, under the Constitution and the law of slander, ultimately, he is contesting his eligibility to coach amateur athletes involved in Olympic sports, a remedy only available under the Amateur Sports Act. Consequently, these claims are outside the subject matter jurisdiction of this court. The court further notes that the two exceptions to this general rule, as laid out in Lee, do not apply in this case. How many times did Marion Jones pass drug tests. Plus Lance has failed test before. His contention in the first one was that the people who performed the test had not jurisdiction.It is just a thief saying, I have not be caught before,... that is why they are bringing evidence forth

I know it is a typo, but it is ironic that you turned hearsay into heresy. Lance has worked his butt off to build up his brand in order to make any allegation of doping heresy against the great cancer survivor Lance Armstrong.

Lance had the best doctors in the world who knew exactly how to manage dosing in order to avoid positive tests. When Lance came out of retirement, he said that he would undergo an expansive biological passport self testing to show everyone that he was clean. He ditched that as soon as he really started training for the Tour.

The only way to catch the micro-dosers and the guys with the docs who know how to beat the test is to get someone to narc on them. It looks like USADA finally did that.

As for the court case, athletes want to be regulated under the various anti-doping associations because they do not want to have civil or criminal liability for doping. Can't have it both ways. If you want to have a private association enforce doping rules in your sport, you also consent to the standards and procedures. If you do not want that, then get ready to be sued for fraud and prosecuted for violating doping laws (which would need to be enacted in the absence of a rivate doping agency).

I love this line from the Velonation article (http://www.velonation.com/News/ID/12343/USADA-says-it-is-following-established-rules-confident-Armstrong-case-will-continue.aspx):

"Ironically, Armstrong’s agent Bill Stapleton was the president of the Athletes’ Advisory Council at the time when USADA’s policies and procedures were drawn up, and had a big part hand in writing that code."

I was surprised to see this thread not filled with Armstrong defenders making the waste of resources argument against any further investigations or sanctions against him. To those who do buy into that, I'd say sport is serious business and if it takes some funds to make it reasonably honest, so be it. And, to to those that welcome complete deregulation of sport and the allowance of drugs, I'd say the following. All sports have rules that are arbitrary. It's part of the game. These rules make things challenging and interesting. If drugs are allowed in sport, it's a way of getting around or super achieving over the rules. Then what is the response? Make the pitcher's mound, for instance, farther away? Outfields deeper? Make The Tour longer and steeper, etc? Then, what? Better drugs? Additionally, while some think most tour riders are dirty, and some passionately defend Armstrong on those grounds, I bet if those people could know who was totally clean (imagine some magical object that could divine that) among the top finishers they would hold that rider in much great esteem than any other.

I think you make two separate arguments here. 1) should sports uphold their rules consistently and 2) should the government become involved if sports break their own rules?For example, with the spygate incident when the New England Patriots videotaped other team's practices. there is an NFL rule against this. I feel it appropriate by for the NFL to make a sanction against The Patriots. I would not appreciate the US government investigating into the scenario, because there isn't a US government law that says "you're not allowed to video tape opponents practices."I agree certain rules like pitching distance are necessary for the integrity of the game as a fan. I don't agree with that statement as a US citizen. Let MLB measure the pitching mounds itself, and if it finds no fault, why should the US government be out there with a tape ruler? That is a waste.
