I know exactly what a cease and desist letter it. People who are going to sue don't send them. Because a smart lawyer would just sue and let me keep posting stupid sh!t to help me build his case. But if he did sue Mike's lawyer would be in for two very huge surprises.

1.) when the IP addresses are sorted out he's gonna find I didn't make most of the comments attributed to me via anonymous screen names. Especially the nasty comments about his family. Those are most likely from Mike's own minions trying to turn people against me - thinking I was posting anonymously as well.

2.) Mike has done crazy sh!t and could be facing up to a half dozen counter suits for things he has done and said about people. I don't think his buddy, the attorney has any idea what he is getting himself into.

I haven't posted anything over the last few days because I think the brojo's story is getting traction and I didn't want attacks on me to distract from that. But I have not been silenced.

I've made it clear that he started with me when I commented on a news story. I will not be bullied or intimidated.

The most interesting thing about that C&D letter, aside that his lawyer uses AOL for his email (really?), is what it does not include as false allegations. It mentions false allegations of parental unfitness, violation of copyright laws and incompetence of his profession. However and most importantly (so pay attention trolls and Mike's minions), it does not mention anything concerning statements of cheating, being a cheater, cheating at the Via Marathon, statements that he could not have possibly or is not physiology capable of running a 3:11 marathon, or being a liar or lying. Why not? Ken, as well as others, asserted all of those. It is because those are not false allegations. The attorney, in his C&D letter, effectively acknowledged and admitted what we all already knew, what now the media is also now realizing as well as many more people, and have steadfastly asserted and what LRC has exposed.

Because if he gets sued , it's not about the cheating . It's about being accused of parental abuse/unfitness incompetence of profession etc . That's why . The lawsuit and case if heard by a judge would only address the issues that would be filed in that C&D . As a matter of law , a judge won't care about the cheating , who said what about what race , the price of tea in China or what it takes to grow tangerines ! Do you think for example if you were involved somehow that you could say : " but judge this guy is a cheater he wasn't in photographs " etc etc ? The judge would say to you we aren't hear to discuss that , we are here to discuss the accusation of parental issues , how does missing photos of this guy in a race determine he is abusing his kids ? .... That's why the C&D only mentions that stuff .

And if Mike were to sue me he would have to prove that I caused any of this.

How would posting things about him and his family on a message board that he doesn't admit to reading hurt anything about his marriage?

How am I hurting his video company and promoting mine when neither has been mentioned? Only East Coast has been brought up. And I think Bob is smart enough a businessman to just stay out of this fight. He knows that nothing that gets said here is going to be seen by one of his clients.

The cheating will become very relevant to a court case because when the evidence against cheating is shown to the judge and he determines that Mike did cheat, the question then becomes - why didn't you just admit it and be done with it instead of welcoming all this drama onto yourself?

And if brought on yourself, how can you now claim that one man with a few comments on a message board ruined your reputation?

Sorry, bro, but Mike ruined his own reputation. And who knows what news organization is going run with this story tomorrow and make it worse.

Even if he won, in the end all Mike would have is a judgment against me for X number of dollars. Running a sole proprietorship business I'm smart enough to have no assets in my name. So good luck waiting on that check.
