How exactly would Mike Rossi sue anyone? You can't sue someone if they are right. Am I wrong here legal experts? Wouldn't he need to show that whoever he is suing was knowingly spreading false information with malicious intent?

Well, I'm sure some are malicious but they aren't saying anything they know to be false because Rossi did not in fact run whatever Podunk Marathon we are talking about. He'd have to prove in court that:

A) He did run the marathon.

B) That the Brojos or whoever knew he ran the marathon and knowingly said otherwise in order to cause him harm

Of course if MR could prove A, then this thread wouldn't have ever gotten to page 2.

Legal guys, chime in, if I'm wrong here. I admit to having less legal training than Lionel Hutz, but this is how I understand things.

So I can't boycott the Color Run because .05% of net goes to the Ronald McDonald house?

I don't think you can really cheat at those (not timed?) so I'm not boycotting for any particular reason like I now am for the Via. I just think the Color Run is stupid so I won't ever do it. Buuuuut, since they gave $45 (per race, not registrant) to stop poverty, I'd better rethink things.

I'm wondering if Mike Rossi is the type who doesn't know when to quit when he's ahead. If he starts going all over the place on social media saying this decision proves he ran the race it could get him more unwanted scrutiny.

I do think that Boston should strip the Lehigh valley marathon of their BQ status, I'm pretty sure people have been convicted of murder with less conclusive evidence than this.

Not surprised he wasn't DQed. It doesn't matter what Lehigh adds to prevent cheaters because they just showed they don't have the will to DQ anyone.

We need to get him DQed from Chicago, I don't believe for a second that he's not running it and he's using that 3:11 to get in. We can't take Boston away from him anyway but we can take Chicago.

Let's review that statement you just made , and maybe I can use it to put into context for many people why the decision that the review board came to makes sense. this is "an anonymous message board" , however when an official inquiry into any unbiased or valid investigation on any matter is conducted, people who are interviewed can no longer remain anonymous. Their names and identity goes on record, and they are held accountable for their statements , you can post anything you want on an anonymous message board, whether it is the truth or not, however , when peoples names go on the record it is quite a different story . VIA didn't need to interview anyone on here .... they already knew your positions, there was no need to interview any of you. And the evidence this board used to argue it's case was weak , from the standpoint that the popular view on here was that " everyone that was in the race had their photos taken on that bridge is false " .... What are the chances that MAYBE , just MAYBE , during the coarse of their investigation they did find evidence of him on the coarse ? Or maybe an independent photographer , or news station or someone other than US CANDIDS had information that not everyone here knows. .... memo to lets run haters : The VIA board and investigators have no obligation to share their findings with ANYONE , except the people involved . I would say calling people "haters" is name-calling.

You make some valid points for someone who would want to defend Mike. Here's my one big problem: it's become pretty clear that he had legal representation in his defense rather than proof that he actually did run. That speaks volumes to me but it's just one humble opinion.
