Even if there is, it is hardly in his best interests to have a bad relationship with his mom on top of any potential health problems. I am sorry your sister is so thoughtless. At this stage you still have time to try to talk some sense into her (an intervention of sorts) or to hope/pray that your niece/nephew will be born healthy despite your sister's narcissism. You're not doing yourself any favors by worrying about potential lawsuits.
It's actually better for a smoker to continue smoking while pregnant than to try to quit.

He has to prove damages then hope there is something to recover then hope he can recover it. Your sister sounds like an idiot and idiots typically don't have much money.

This is an interesting ethical question. A typical liberal would probably say that smoking during pregnancy (or even smoking in the home after the child is born) could be considered child endangerment / abuse. A typical conservative would say the government has no business interfering with a private citizen's decisions.
But flip "smoking" to "taking an abortifacient" and the tables are turned. Fascinating.
