You are correct in that the EPA didn't pollute the mine. They did however breach the dam that allowed the pollutants to get into the river.

But, I think I would argue for VW that the laws require that we pass the tests... and we did.
U.S. is who discovered the fraudulent software in the Diesel engines, as tricking the emissions numbers.
But if the U.S. doesn't score super high in teen-years math tests, then we're supposedly not smart enough according to public figures. The U.S. discovered the fraudulent software- not the higher test scores Asians. This was the REAL test.

Totally different situation, the ignition switch issue was unintentional while this whole VW ordeal was 100% on purpose to evade certain laws in the US. This was not a neglect issue.
