I live on a lot that is accessed via a private drive (no street frontage). Our driveway runs between two empty lots, and is actually an easement on one of them. The lot that does not contain our easement is under development, and the builder has constructed part of the dwelling over the property line onto the empty lot/easement. He has also violated the setback to our lot and placed fence posts on our property.
We had warned him that he was laying out his building incorrectly, but he ignored us and poured the foundation and built walls while we were out of town. We then had a surveyor come out and prove our claims. The builder acknowledged in writing that his work is in the wrong place and violates city code.
We contacted the city and they have placed a stop work order on his site. The builder seems to think he will be able to simply purchase enough of our land and the empty lot to satisfy his setbacks. He thinks that 12K for both parcels is a reasonable offer for this. The guy is a massive douchebag and his building is an eyesore. If he wants to buy my property he is going to pay through the nose (a price slightly less than the cost of moving his building over 10 feet to meet code requirements).
Thoughts on how to maximize his payout? How would letsrun handle this?
