New Sam McGorty 800 video is behind a paywall... there is definately a lawsuit here for minors who'e likenesses they are using, these are not NCAA athletes.

You are ignorant.
Does ESPN not show high school sports all the time? What's the difference?

Not at all. Commercial use is a whole nuther ball of wax from just filming stuff.
If you take video you plan to sell, get signed permission from everyone in it, or it could cost you. Exceptions are mostly informational-based fair use like news. A race video is entertainment.
I think he was referring to the 'Sam.' What was his time?

They more than likely have consent from the parents. I would guess if you don't consent, you don't get to play in the game.
Don't know whether flosuck gets this consent, but if they are filming on private property, that venue probably has every athlete sign the consent form to compete.
Even if they didn't I would imagine if you sued for the complete value of their profit off your likeness, it would net you about $2.67. Flosuck could also just never get any consent and then if an athlete complained, they could just dump it on youtube so everyone could view it while holding the others hostage until they felt they had no monetary value left.
