Hey lawyers, if Rojo did not assault Wejo, would Wejo then be guilty of libel for claiming that he did (regardless of whether or not Wejo speaks one of the Chinese languages)?Could Rojo then sue for damages to his reputation (granted the value placed on this likely would be a very minimal amount) ?
Shocker that wejo/rojo can't get scoops or people in the know to confide to them.
Assuming he is suing him in a US court under US/state libel statutes, this is actually a very interesting jurisdictional issue because said events occurred outside the US and was arguably published outside the US, but communicated to those inside the US. Nevermind the facts that these two are using corporate/business channels to communicate but both own the business.
Aside from the jx issue, the common law elements of libel are fairly straightforward.
Written statement? Yes. False? Yes. Communicated to third party with understanding it was about plaintiff? Yes.
Defamatory? A lot different case law but essentially if it harms the repurtation of another in the community or deters others from associating with him, then yes. It is a question for a jury. If I was plaintiff: a complete fabrication aimed at destroying the credibility of a fellow journalist if only to take over the business. If I was defendant: the two brothers were drunk and the comments was obviously a joke and understood to be by the relevant audience as evidenced by replies on the forum.
Damages:
Special damages - depends on outcome of statement: "A plaintiff in a defamation case is entitled to receive damages for any lost earnings, future lost earning capacity, and other lost business or economic opportunities that he/she suffered or is likely to suffer as a result of the defamatory statement. If the plaintiff is self-employed, lost economic opportunities may include such losses as loss of current clients or a reasonable expectation of losing future clients. Regardless of whether the plaintiff is self-employed or not, lost economic opportunities may also include the plaintiff’s inability to get a new job if the plaintiff lost his/her old job as a result of the defamatory communication"
~General damages: "These non-economic damages in defamation cases also include such injuries as impairment to the victim’s reputation and standing in the community, personal humiliation, shame, and disgrace"
So, to fully answer the question it will cost you about $50k in legal bills and he will likely recover $200 if he doesn't lose his job lolz
