The new rule is complicated but Tolleson is fine. The other team has to fix the shorts so they are the same color.
Example: They can wear the same style they are wearing but they have to be the same color(s).
The new rule says if the UNDER garment is above the knee anything goes- mix and match.
If it goes below the knee they must be exactly the same.
Oh, and hair clips have to be 2" or less and no watches in track but they're ok in XC.

This is from the most recent (2013) freely available rulebook that I could find. What a riot, by the way...making the rules and then forcing you to buy the rulebook to read them.
Do note that the undergarment rule was "clarified" recently to mean that it applies to ONLY undergarments that extend BELOW the knee. Anything above the knee is a foundational garment and no restrictions apply.
As for "same design" I believe that the AZ milesplit article is incorrect with their extremely strict interpretation of what constitutes "design", because the general section on uniforms says this:
But the rules go on to explain that, for example, "Each competitor shall wear a full length uniform top or one-piece uniform
issued by the school" which seems to indicate that--as is the case at many meets--some runners could be wearing a speedsuit, while others could be wearing shorts / singlet. Which is obviously a different design in the strictest interpretation.
Also the poster talking about watches is incorrect. NFHS allows watches in track. Rule 9-6 article 3 section c.
As most know the jewelry rule is not in effect anymore. Though NFHS still bans "rench or high-cut apparel" a.k.a. bun-huggers. LOL!

The rule was changed in 2014 to what I said. Basically, if it's under the uniform and above the knee anything goes (it's considered underwear).
If it's the uniform it has to match BUT:
One girl can wear spankies, one the shorter spandex (boy cut?), one regular running shorts if they are all the same color and striping.
