Tough Mudder will and should be bankrupted for this. Its one thing to have a difficult race, its another to design a course which contains a well known danger such as muddy water.
I don't care how many lifeguards you have on site, you never jump into water when you cannot see the bottom, and you never encourage others to do so.

A well known danger such as muddy water? I'm not even sure what muddy water is... Was it mud or water that was brown because it was contained in a dirt hole?
And never jumping into water when you can't see the bottom? Almost any lake, river, or ocean would fall into this category. Even in this specific case I would not say jumping into a pit filled with water which hundreds of others are doing with lifegaurds is a known danger. If you are this paranoid of the world I'm sure you wouldn't be signed up for an event like this in the first place.
People sign up for these things knowing full well what they are getting into and if they feel uncomfortable they could always just not finish the event.
It's very sad this happened but from what I have read it was an accident and we shouldn't be trying to assign blame to anyone or anything. Disclosure: I personally don't have any interest in ever doing one of these "I'm so tough, look at me" events and do thing they are a bit stupid.

A video of the incident was briefly posted that showed over 6 minutes of footage of the rescue effort. At the start of the video, it was known that the participant was missing and in that pool of water. The response effort was very minimal, consisting of one or two divers trying to locate the athlete. They were yelling at others trying to jump in to help and forcing them out of the water.
The video stopped when TM forced all spectators to leave the area...that was at over 6 minutes and the person had still not been found.
If you're going to put in an obstacle like that (murky water), it's not "safe" unless you can quickly verify and clear out the obstacle from a potential drowning incident.
Yes, TM has tons of volunteers and they make lots of effort at safety; however, this poor rescue plan resulted in what was most likely a preventable death (probability of brain damage due to oxygen loss drastically reduced at minimum).

And Tough Mudder sounds like they are in full CYA mode, saying that there was not "criminal wrongdoing" by Tough Mudder. Surely, participants could expect a little more than Tough Mudder not committing criminal wrongdoing.
