It's called prosecutorial discretion and when you're going after the leader of the party that you've publicly campaigned against, you had better have a rock-solid case for a substantial crime. Any credible voice on the subject knows this case has neither.
The Democrats have a habit of doing this - breaking long-standing legal/political precedence for short-term gain without realizing that this will come slamming back on them in a few years when they are not in power. Every Red state AG now have the precedence to go after basically anyone they want on the Left.

Fascism under Mussolini was characterized by ultra-nationalism, opposition to Marxism, suppression of feminism and other egalitarian movements, hostility to migration, and criticism of global free trade, with it's authoritarian leadership having a cult of personality. Nazism under Hitler incorporated this and expanded to include an obsession with genetics and race being the foundation of the nation.

You saw that with, e.g. the National Socialists when they instituted a higher minimum wage, nationalized industries, set price ceilings, blocked economic mobility, put up hordes of regulation on industry, manipulated the money supply, etc.
