Gatlin's supposed first conviction was because he didn't properly seek an exemption, according to North American Arbitration Sport Panel that heard his claim against USADA:

One of the incoming runner's responsibilities is to NOT pass until they are at the passing zone line.
This is very simple, regardless of level, and in my coaching, I clearly identify fault during relay practice and re-iterate responsibilities if athletes screw up. (I have been relay coach for a multi-sport games in which the teams I was coaching had 2.75 sec and 2.56 sec differentials between SB sum and 4x100m times, on 2.5 practice sessions.)

You are probably right that he left late.
However, it is the baton carrier's job to make sure it does not get passed early. My high school athletes know how to run side-by-side in the same lane with a baton without tripping each other; I imagine a couple of Olympians can do the same thing.
Plenty of blame to go around.
Even more props to Gatlin for remaining composed if it was his fault.
