Berian did not have a signed contract and cannot for 180 days. He can sign with whoever he chooses after that.

Which is what I posted but without requiring Berian to sign with Nike. Nike paid him no money. Berian does not sign with anyone for 180 days. The rest of your post assumes the judge would force Berian to sign with a company they doesn't want him. Not a chance that will happen. The judge cannot force Berian to sign a contract with anyone.

I actually change my answer. It'll have been 180 days of the year some time this week I think. Judge says as of that date Berian can run for whoever he wants. The rest will get sorted out later

Doc Brown is right. Something for Nike (180 days). Something for Berian (sign with whoever). nwpow assumes Nike gets to force Berian to sign with them. 100% Nike.

This hearing was on Nike's motion for a temporary injunction barring Berian from competing in a competitor's gear. That's the only thing the judge will rule on today. No ruling on forcing Berian to sign with Nike. No ruling on monetary damages.

Just a quick correction. Your page says that the judge is Jacob Hernandez. It's actually Marco Hernandez. For a federal district court judge, he has a rather unusual background, and I think it adds some more drama to this.

Didn't say he'd force him to wear NIKE, just that he would side with their lawyers. Once the 180 days is up he'll be free to sign with whomever. In the meantime the judge will agree with NIKE in that Berian cannot wear their competitor's gear.
