I am so conflicted.
Is there a way for both parties to lose? I hope so.

What a joke. 100% siding with McDs. They have ZERO obligation to serve this weirdo who tried to order food on foot through a drive through. Another example of ridiculous lawsuits driving up prices for everyone else so that a tiny minority gets their 2 am Big Mac fix.
As far as I can tell, McDonalds is violating the ADA.
boohoo
everyone is offended at everything
I am offended by your post.
Welcome to Obamas America
McDonald should put their motion to dismiss in braille to appease this idiot.
I am going to file a clASS action lawsuit against MvDonalds for not having the words "Drive Thru" written in Spanish. How am I supposed to know what it says if English isn't my natuve language?
The lawsuit is dumb of course, but why won't McDonald's just serve people on foot at the drive through? Who cares? What difference does it make to them?
How did he even know he was in the drive thru lane?
At first I thought this was a gripe with the #3-11. I think it is absolute bullshit that I can't order a big mac or a god damn double cheeseburger (@ $1.89 mind you) past 11:59pm.
But hey, someone sued a long time ago over there not being a "caution: hot" on a coffee and won. See Liebeck v. McDonald's Restaurants.

Because someone in a car won't see the person on foot and run him over.
There is no reason why McDonald's couldn't have two windows: one for drive up and another for walk up.
Why isn't everyone looking on the positive side? It will be sweet to now be able to walk up to a drive thru window at night and order chicken nuggets! Don't have a car? Not a problem! Step right up for your chicken nuggets! I could really go for some chicken nuggets right now.
I wonder how many blind lawyers are employed by the law firm representin this jerk?
Sue them, as well.
There is a McDonalds a couple blocks from my campus that has a walk up window open at night. They make a ton of money off kids late at night. Obviously it would be expensive to open these up and not all locations would get the kind of business it would near a college campus but it would be a good idea for them in the future, and it would make the blind happy.
And yes it is amazing to walk up and order nuggets at 1 AM, especially because there's usually a good reason you are not driving.
So what the hell is a blind guy doing walking around in the middle of the night anyway?

Agree, I totally wish they would just serve him. But not everything needs to be a law.

Daylight vs. middle of the night makes no difference to blind people
You're right, not everything needs to be a law.
Maybe the workers should have seen the guy, said whatever he's blind, gave him his nuggets he could have gone on his way. I get that they have a policy against that, but there are times when you can get away with breaking them. I've worked as a waiter before, sometimes you break a small rule and go above and beyond what you're supposed to, but guess what? The customers are happy and will come back and no one needs to make a big deal out of it. Unless your goal is to get some moruns on letsrun to discus it. Then make a huge scene.

Blind guy walking should get in the car with the blind guy driving and solve the problem in one fell swoop.
This isn't an ADA issue, because it isn't about being blind, because this policy affects everyone equally. ANYONE without a car can not get food via the drive through. And it isn't just McDonalds. Pretty much every single fast food drive-thru has a no walk up policy. The corporate reasoning I have heard is safety. And it is a totally legitimate concern as well. Last thing you need is some guy walking up to the window get hit by some idiot not looking driving his car. Because you as a restaurant will be legally liable.
Several years back a few friends and I tried to walk up to a drive-thru and were turned away. None of us were blind or handicapped. We just happened to be in town without a car so we were on foot.
