Matt and charles. Easy solution. Run fast enough to get a time qualifier and you will it have to worry about the lottery.
Slow people need to stop being so butt hurt about not getting into races. NYC has auto-qualifying times.

granted, a fast enough time will allow somebody to bypass the lottery but the time qualifier won't be able to bypass the $11 lottery fee.

I think what this will come down to is if NYRR can reasonably demonstrate that the costs to run the lottery are close to the money they take in through it.
I believe they have around 200k applicants, so $2,000,000 coming in through the lottery.
What expenses do they have:
1. Credit Card transaction cost - around 2%
2. IT infrastructure - they have that anyway and the software should be good to go from last year
3. the Drawing itself - obviously for the most part software again that's already there, but then they sometimes invite running celebrities - are they paying them $$$ ?
I just don't see their cost for the lottery exceeding $1 per person.

Not really that great since its premise isn't correct. People that aren't serious won't give their credit card number that would automatically withdrawn $200 if they are accepted.

Well, NY State law outlaws any "lottery or sale of lottery tickets, pool-selling, book-making, or any other kind of gambling, except lotteries operated by the state."
Seems to me like charging people a non-refundable $11 (or whatever it is) fee for the right to win entry into the marathon is gambling. Then again, NYRR is probably giving so much money to the state legislature that this case will be dismissed.
I hate NYRR. They have a monopoly on CP races, overcharge for everything, and claim to be a non-profit yet just sold some of the most expensive real estate in the city. Non-profit my ass.
After Fred died, the corporate greed of people like Wittenberg really took off and turned the NYRRC into another phony "non profit" organization. Losers, every last one of them.
You guys forget FDNY/NYPD/Santition blackmails NYRR for overtime pay and free perks. NYPD also extracts bribes from Mom & Pop shops, cab drivers, hookers, meth dealers, etc. It's a good way to make a living being in FDNY/NYPD/Sanitation.
