I could be wrong, but I don't think I am. I am pretty sure no NCAA institution has ever had NCAA sanctioning imposed upon them or faced any actual penalty for non-compliance with Title IX. It is my opinion that to do so would open up the NCAA to the kind of law suits that would bankrupt them. The reason? The NCAA would have to prove that no other university was the same or worse than the university facing penalties, or they would be creating an uneven playing field. This is next to impossible to do if you are the NCAA. All they have in their arsenal are empty threats.
If this is in fact true, then it is also true that institutions citing Title IX as their reason for cutting program like men's track and field are full of shit.
