I think you can not patent algorithms -- only inventions.

I would agree that targeting a fixed number of repetitions is not the primary goal of an interval training session.
Who needs "sled towing, parachutes and all the other toys, gadgets and gimmicks"?
Hitting the necessary certain percentage of top-speed for sprint repeats is not difficult. This is a patented solution to a problem no one has.
If current training plans that include sprint repeats are based on coaching experience and success, how serious and significant can the flaws of standard sprint repeat programs be?
I coach High School boys and we use this for our 400 down kids. Have seen great results and the main thing is the kids love it and are excited about track. Our 400 guys finish stronger and are running better times than they ever did with old school "Clyde Heart" style of training which is what I used to do.
