The minimum is he should be fired and barred from any police department job in the United States and Possessions. Killing two people cannot be excused in any job. No pulling the WHITE CARD here.
What if the driver was instead your grandmother (who shouldn't be driving to begin with) and just misjudged the turn? Should she go to jail? Should you or your parents go to jail because you knew she wasn't fit to drive?
This is an unfortunate accident that is magnified by the fact that the driver was a cop.

Also need to consider how much overtime/moonlighting the cop has been doing the last month or so. That may factor in to why he fell asleep.
Cops generally double their paycheck with overtime and moonlighting.

That would save his family, kids, wife, fellow cops, County of Santa Clara, Northern California, etc. from the next 20 years of criminal investigations, lawsuits, court fights, U.S. Justice Civil Rights investigations, an unending nightmare.
Knowingly driving while tired constitutes Willfull Neglect, Dereliction of Duty, and criminal Manslaughter. He should be fired, barred from Law Enforcement for life, prosecuted and sentenced to at least 30 years in prison. Think of the victims, their children, parents, friends. The County will be paying out the ass for liability for 20 years.
