i'm no chess player but i'm going to have to side with hans here. cheat or not, they made accusations that would ultimately destroy his reputation in the chess community for the rest of his life.
I hope it goes to court so Hans will have to explain under oath how he's played better than every other human in history at their peak. He will have to explain how he's played dozens of games with 100% accuracy, orders of magnitude more than any other player (except for other cheaters).
Letsrun better hope Hans LOSES otherwise this website and all of it's posters are going to be sued into oblivion from all the athletes that have been accused of doping.
Hans winning will mean Rupp can sue LRC for 100 million.
I dont think he's got a case against Magnus. Magnus has never said he's cheated. All Magnus is doing is refusing to play against an admitted cheater. You might not like how he is doing it, but there is nothing wrong with it.
Chess.com on the othe hand has said that Hans cheated more times on their platform than he's admitted. If they dont have some good data to back that up, they could lose a lawsuit. I'm pretty sure he won't get a hundred million from anyone.

hans does not need to explain any of this because he's not the one accusing someone of cheating. if asked in court, hans will simply say something like, "i played chess to the best of my abilities" and say nothing more.
if what you're saying is how courts should work, then lets use running as an comparison. how is usain bolt not a cheater if he can beat every person in the world at 100m, including cheaters? will usain bolt giving you his workouts prove that he isn't cheating? will usain bolt turn his DNA into binary code and throw it into a simulator to prove that his 9.58 is humanly possible? no

There is plenty of evidence that he cheated and Hans won't be able to refute it in court. Chess.com has evidence of every click he made while using their site.
They found every time Hans clicked out of the game window, his move accuracy increased significantly. So he was literally not looking at the board and was looking at something else and he played more accurately than times where he was only looking at the board. Was he looking at pictures of puppies? Or maybe he was using a computer program to find the best move.
A better example is a guy that flips a coin and gets heads 3 million times in a row.
Hans already admitted that he cheated online. The issue isn't if he's ever cheated, it's how much he's cheated. Hans will lose and he'll have to pay everyone else's legal fees

Maybe he was making himself another cup of coffee?
And another thing. People have lied about his stats being impossible.
But the issue is about his over the board game. Have you ever watched him play? He's on top of his game and everyone else's right now.
Hans is an admitted cheater. Even if he wins against Chess.com the damages awarded will be minimal. What’s the value of calling an admitted cheater an even bigger cheater? Very little.

The loser doesn’t have to pay the winner’s legal fees. Which law school did you go to?
I think he is gambling they will settle, if it goes to court it will not go well for him as Chess.com present their evidence in painstaking detail. At the moment this is contained to a fairly small audience who are interested, at a trial he will learn about the Streisand Effect.
Considering how high his IQ must be, I'm just going to say Hans probably made the right choice here and call it a day.
As a person who suffers from low IQ myself, sometimes you just have to throw in the towel and accept that somethings are beyond your understanding. I don't know man, that's just how it is sometimes, right?

One of the more glaring things that chess.com could be sued for is breach of confidentiality. Maxim Dlugy pointed this out in his statement a couple of weeks ago. Chess.com published information on cheaters but many Grand masters names were kept anonymous to preserve confidentiality agreements. The Grand masters admitted to cheating to get bans lifted and keep playing on chess.com. This was kept secret because of the streaming $$$ these players bring in to chess.com.
In the case of Maxim Dlugy, he had a written agreement not to ever divulge his admitted cheating. Chess.com broke that agreement. This is most likely the same with Hans. Magnus was privy to inside information at chess.com and leaked it. Hikaru simply flat out accused Hans of cheating without any basis.
Chess.com has an OBLIGATION to report cheating because they host FIDE tournaments and other tournaments with cash prizes.
The cheaters have no right to privacy - as long as their home addresses and other personal information isn't being revealed. Even if chess.com told someone that they would keep it private as a friendly gesture, they always have the right to go back on that especially when it's in the public interest (or in this case when Hans LIES publicly about his cheating on the website).

He has already admitted to cheating. He destroyed his own reputation.
