Agreed for the most part. The only possible violation they may have is an infusion greater than 50mL on Magness. The rest is absolute speculation.

The one thing that troubles me is that prescription strength doses of various vitamins/supplements/etc... were pushed on these athletes and the athletes may not have been given the full information about side effects.

Granted, the athletes were in an environment where they knew not to ask questions because they did not want to upset the coach/decision-maker/holder of the purse strings.

Rowbury is starting to look a lot like Radcliffe.

This is a side point, but: HIPPA only applies to medical personnel, not to other people who happen to have the information. For example, the janitors at hospitals are not subject to HIPPA.

There are exemptions when the info is part of an investigation by legally authorized organizations. More than just a "smoking gun" for Alberto and assistants, practicing medicine without licenses and dispensing prescription drugs is very, very illegal, the kind of illegal that will put someone behind bars.

TMB is under no obligation to turn over the medical records to USADA. Look for a large lawsuit from all of the NOP athletes against TMB to prevent it from doing so if the athletes (SALAZAR) realistically believe that it is a possibility.

Also, it could just be very poor word choice from USADA (and I actually had that as a comment initially but deleted it), but the closing paragraph to Section III referenced the joint investigation. But then there's the reference to protections to protect confidentiality of information shared between them based on their individual mandates.

l-carnitine and vitamin d are like water: they are legal. taking more doesn't make you a doper. in fact, athletes have special fluid mixes to enhance performance. why not take more l-carnitine if you think it will help you? it's a legal substance, like kale.

why not try to increase levels of testosterone through legal means. you'd be a fool not to.

1) As has been mentioned, it would be very hard to prove prescription fraud in a case like this. Dr. Brown's not the only doctor pushing thyroid hormones. Moreover, he has a well worked out theory for why it's medically sound.

Since prosecutors could have charged him long ago, that they haven't suggests that they aren't going to.

2) The statutes of limitations for these crimes are all relatively short. Five years under federal law, three years under Oregon law. Plus, some prosecutor has to decide these cases are worth pursuing, which is not a given.

Are you sure about that? Prescription strength ibuprofen is 800 mg, yet I can hand my wife 4 200 mg tablets and no crime has been committed.

And had they just done illegal doping with EPO and testosterone under the care of a doctor, they probably wouldn't have jeopardized their health as much as these shenanigans.

Do the people freaking out over this realize EVERYONE knows the NOP seek performance enhancing recipes from legal supplements. It feels unethical to most of us.

New public outbursts change nothing from how people felt about NOP five years ago.

I for one am impressed by NOP's performance and success when considering they're under intense scrutiny for Vitamin D while many of their competitors are legitimately taking hard PEDs.

A few of my takes:

1. To Julian's credit he seems to have the athlete's long term health as a priority. A few months ago there was the story in the Sunday Times where he told the team to stop using the L-Carnitine. Now this revelation that he asked the team to stop taking calcitonin. How and why he's still at the NOP is lost on me. If they're clean, the dude has got backbone. If the team is dirty, the dude likely knows all of it. He joined the NOP in September of 2012, and it sounds like him and Welling were a bit "deer in the headlights" when they went to Dr Brown in Sept 2012.

2. This looks bad for the NOP but it's a case I wouldn't dare bring to trial. USADA is speculating and hypothesizing on the testerone and whether or not the NOP took more of the Lcarntine. The LCarnitine seems to be a reach anyway. It's a legal supplement. I've contended before on these boards that it seems USADA is wasting its time and money on trying to prove whether the LCarnitine was over 50ml or not. Lots of athletes using EPO and steroids out there, and they're bogged down with an amino acid. Now the testerone is whole different matter, but it's still Salazar's documented word Vs USADA. Without real proof, well....

3. The NOP is still competing and this report is what, now two years old? I'm afraid to say that if USADA had a next move, they would have made it. Unfortunately, now Nike has USADA's playbook and everything USADA said can now be used against them.
