Are you thinking that a police baton is the same as a track relay baton? I’m sure I don’t need to explain here why that’s ridiculous, but here goes. Relay batons are made of the lightest material possible for obvious reasons while police batons are made from very heavy materials for also obvious reasons.
Except three hits to the head caused a concussion in this case - so regardless of whether it is like a police baton or not it could have long range consequences for the victim. It is also assault. The law isn't applied differently to those stealing 10 dollars or those stealing 500 dollars - assault is assault.
