I think Rowan will argue that they cannot fulfill (most of) the OPRA request without violating Clevenger's FERPA rights. You can't make an OPRA request to get public access to a student's letters of recommendation from his/her high school teachers or guidance counselors, for example, or any internal discussions about admitting, investigating, or punishing Clevenger.
I also think Rowan might have a problem if they were to kick Clevenger off the team, based on “unverified internet rumors” (as Clevenger’s team would argue). If Clevenger were excluded from the team with no additional evidence, he might potentially have grounds for a case against Rowan. Students do not have a “right” to be on sports teams, but schools can’t be reckless or unfair in their removal decisions; students do have a right to due process in such matters.
In short, I think Rowan would have a hard time doing what people seem to want them do because of their own exposure. I am not a lawyer or supporter of Clevenger, but I can see trouble for Rowan here.
OPRA requests take time to fulfill. The law may say the agency has to fulfill the request in 10 days or whatever, but as long as they are providing reasonable updates, they are still within their rights.
Agencies are not required to create documents or answer questions, only to provide existing information that is releasable to the public. The first crack at the OPRA request was poorly worded, but I think the subsequent requests looked a bit better.
Even still, I wouldn't expect a smoking gun to appear from these requests. They are still worth pursuing since it puts pressure on the university and their legal team.
I predict there won't be many developments in the next few weeks. SC will probably race a few fast times before the spring championship season, and then we'll likely have a repeat of indoors where this story resurfaces nationally and protests on the podium, etc.
Over the summer, I 100% expect to hear of runners transferring out of Rowan or quitting the team.

Good points. Rowan is unlikely to make a statement either way. They have their hands tied into a situation where they are forced to look the other way. Clevenger will be allowed to finish out his eligibility at Rowan unless something like a positive test happens.

By my count, today is business day 8 from the second OPRA on 3/21 (not the rebuttal to the first OPRA request). So they should have heard something yesterday. If RCS has lawyered up as rumored, my guess is they're crafting their response/post.

On the first OPRA request, perhaps. I argued pretty much the same a few weeks ago when they submitted it. But, if you look at the second one filed on 3/21, it makes 0 mention of Clevenger. Their only request for comms with Iowa was the presence and timing of any correspondence, not the content. They requested drug testing records but not the results. Just what drug tests were performed (generally by the department) and their cost.
All of which makes me think the rumor they lawyered up is accurate. Imo the first OPRA request made it very easy for Rowan to hide behind FERPA. The second was clearly targeted to avoid that pitfall.
