There are serious legal issues with this. If he exposed himself, as he did while he was defecating, he could have to register as a sex offender. It is not uncommon for the DA to charge someone with indecent exposure in a case like this, and he would have to register as a sex offender. Boston Marathon or not! As we get older we need to think that stuff we did as young teenagers won't fly as adults. I am really surprised no one has said this. This guy's picture is all over the media. His lawyer may fight it, as for as the sex offender change, and that wasn't the intention, but people have had been convicted in similar situations. At the very least he could be looking at a some less serious charges, but he definitely is looking at some time.

Each state has its own list of offenses and conditions under which you can be put on their list, and each state chooses the level of public access they grant — in some states everyone on the registry can be found in an online search, in others only high level offenders can be whereas the low level list is only available to law enforcement. In some states you could be put on the list for going potty in public, but in nearly all cases that’s just used as a prosecutorial tactic. It’s easier to get you to plead guilty to some lesser offense (I once heard of a public peeing case that pled out as “improper disposal of waste”!) if they can threaten you with a charge that could come with sex offender registry if you don’t take their magnanimous plea deal.
