Do you really think the reason behind why someone would trespass would get them off the hook? Once again, tell a judge you hopped a fence so that you could do interval workouts. My guess is he wouldn't give two shits.

my taxes fund the chemistry lab, the basketball gym, and the janitor's closet.

by your logic, i should be able to use the lab (i'm not stealing any chemicals), shoot hoops (when there is no scheduled practice/game), or borrow mops - whenever i want/need.

i love this assumption that because tracks are paid for with tax dollars they are somehow open for public use, or that because you happen to run on your town's track all the time that ALL high school tracks are thus public tracks.

the bottom line is that if there is a locked gate and/or signs saying you need permission to use the facilities - if you hop the fence and don't have permission, you're trespassing.

and no, this isn't a crime on the level of selling crack or killing babies, which is why they have a seperate category, with it's own punishments and fines....it's called TRESPASSING.

Just because a school is "public" does not mean it is open to the public. It is still private property. You because you (and so many others) think something "should be" does not mean it is.

Some school systems do allow their tracks to be used by the public--I was just in OH and ran by a local middle school. A sign noted that the track was open for general use. In Colorado Springs, I cannot think of a high school track that is open (a survey of maybe 6). My high school is a private school and the facilities are open to use by alumni.

One option is to get permission from the AD. If the OP is accurate in helping out with the team, then the coach can go to bat for the guy with the AD.

There are legit reasons to keep the facilities closed including increased maintenance. Sure, everyone thinks "well it is just me" but it likely is not and likely other people then can come over and create problems that might require something as simple as extra clean up.

Lastly, I wonder how many Kenyans worry about having a track on which to do their workouts. If you think you need that kind of precision, well I suspect that you are simply being misled.

I'd comment, but since I pay taxes for the public courthouse I am off to have a picnic on the roof.

Paying taxes does not allow trespassing "rights".

This whole situation is simple from what I've read. The runner spoke like a jerk and lied to the rent-a-cop, who then took on the same attitude. It could have all been avoided had the runner acted at least mildly apologetic for ignoring the rules of the property.

Liability is still there idiot. They should have the tennis courts locked as well.

It might depend on the state, but both are trespassing. However, picking the lock might up the grade of the offense.

Whenever a poster brings out the "crawl under a rock" insult, it means they long ago lost the means of saying anything useful and have hypocritically resorted to flinging out the same insults they criticized others for using. At GT our track is locked and open to the public (i.e. students and faculty) from 12-1:30 for walking/jogging in the outside lanes. God help you if coach Hindsdale finds you there at any other time.

Just because you pay taxes for something doesn't give you the right to use the facilities at any time without permission. I always love it when people feel they are entitled to things just because their taxes paid for it....follow the logic, it doesn't work. I don't have any expectations that I have free-run available to me at NASA any time soon just because my tax money helps support them. That's like saying when you give money to a charity, you have a "right" to use their facilities....

If the gate is locked and a person jumps the fence to get in, it's wrong.

We need to all play by the same rules. Locked gates and doors mean that the venue is closed at that time. If you want permission to use it, GET permission....don't jump the fence.

Our local school locks the gates on the track on Friday morning if there is a big soccer/football game scheduled for that night or Saturday. The don't unlock the gates until after the completion of the event...(make everyone go through one gate for admission). If you jump the fence during the day, you'll probably get a "talkin' to".

Also, around here, there are definitely open "hours" posted on most venues. For instance, one track near hear closes at dark. Which, during this part of the year, sucks...

We used to do this all the time. After playing in the summer league, we would open the window a crack and the janitors wouldn't notice. The next day we could crawl through the window and play all afternoon.
