Bunch of pervs here thinking age of consent 16 with someone much older is a cool law. Almost as backward and medieval as France.
In those ancient times when it was cool, you either married her first (with her father's permission) or else her father could force you to if she got pregnant. In modern times you have a 16 year old welfare mother who can't finish high school or gain the tools to ever support herself. That is not cool, they are too young to have a clue what they're getting into.
They are both above the age of consent in that state, what "criminal" act are you accusing them of? Being lesbians? And yes, it's hot.
It is called "Institutional Sexual Assault" so the fact that the victim was 17 does not matter. Also, it appears the school was in Delaware but the "activity" happened over the border in Pennsylvania, so there may be federal law involved.
Also, to answer the OP's question, the husband could be a mandatory reporter.
The adult is in a position of authority. Regardless of the “age of consent” a minor under your care can not legally consent.
I would not report. She is my wife and that is absolute no go to snitch, er, report. I don't know how it is in the US, but in EU, even with crimes that are mandatory to report, otherwise you may be an accessory to crime, or be liable for not reporting (the crimes punishable by at least 8 years of imprisonment), if the mandatory reporter is a close relative to an offender (spouses, partners living in same household, siblings and parents-kids), you are not liable and you do not have to report.
I would be angry for sure and would require from her to immediately break up and never tell anyone. Not because I would be jealous of her female lover, but because it is wrong to be in sexual relationship in the position of power and with a minor.
If it wasn't for the age and position of a student, I would still need to talk to her and get some answers, before I would be somehow OK with this affair with a female. A male partner would not be OK, lesbian partner without feelings and mental attachment, would be acceptable.
He was affiliated with the schools (apparently as some kind of consultant). One would think he was obligated to report any observable condition of abuse. In this light, this doesn't appear to be an interesting question.
Jericho - the rules of evidence at trial are not relevant to whether the husband either should have or was obligated to report. He had a role with the school system. He likely had to report.

I suspect he's looking to get out of the marriage, and this is the absolute best way to go about it. Being a "mandated reporter" is just an excuse in this scenario.
Didn't even know Spotify has a chat function, is that right?
Ryan: Yes, the social networking feature of the Dunder Mifflin Infinity website was infiltrated by sexual predators.
Dwight: I don’t understand why our website has to have social networking at all.
Jim: Yeah, I actually have to agree with Dwight on that one.
Ryan: It’s all about creating a one stop shop consumer experience, alright? You’re chatting with your friends, you’re talking about the latest music, about the election; all of it is happening in our virtual paper store.
Jim: And then an older gentleman asked you “Boxers or briefs?”
Creed: I don’t get the big fuss here, I like the site.
