Let me jump in on this discussion, minus all the epithets. To really make a judgement we would have to see what the barrier looked like. Usually cases like this can divide responsibility (75% one side, 25% other).However, I lean heavily toward the parent being held mostly responsible. When you go to a zoo or amusement park, there are many instance where a kid could do something stupid and hurt themselves. These places can't make it impossible for a 4 year old kid to do something to hurt themselves. A kid could run onto a train track, into a moving amusement ride, into the road, jump off a walkway, run in front of horse. The parent needs to supervise.In this case the parent had numerous kids that she could not supervise. She also should have known that this kid was on the wildside and needed close supervision. Witnesses said he kept saying he wanted to go into the water.For final opinion, I have to see the barrier, but my instinct is that the parent screwed up.
