He can still use section 232 of the trade expansion act of ‘62, and section 301 and 122 of the ‘74 trade act.
The problem is these are complex and hard to turn into “bigly” sound bites. Also, he probably, truly, does not understand them and is just smart enough to avoid trying to explain them.
Of course, he could just ask congress….but this means they will have to go on record taxing Americans and that is getting harder to sell.
You are rightly pointing to the reason why their decisions go the way they do, but I would be shocked if they strike the tariffs down when that is one of the two central policies of this grifting administration.

232 requires an investigation and report from the department of commerce and a report to congress after implementation. It is not set up for the kind of here today, gone tomorrow tariffs on a whim that Trump likes. 301 requires a determination by the US trade representative that a country has violated a trade agreement or has taken act to burden US commerce. There is usually a notice and public hearing process. Again, not set up for tariffs by tweet. Section 122 only allows up to a 15% tariff for a max of 150 days.
Trump is pretty badly boxed in by this ruling. He cannot get any new tariff powers from congress until the next omnibus bill, and that presumes that Trump can gerrymander the House well enough to avoid a midterm drubbing.

This court has no jurisdiction to even approach this subject. The supreme Court already has been very vocal about district courts NOT having the power to issue nationwide injunctions so the supreme Court is going to smash those judges ASAP.
It's a Federal Court. If it had no jurisdiction it wouldn't have heard the case. You lose. Trump loses.
